Privacy policy

This privacy policy tells you what to expect us to do with your personal information when you visit adamsnel.com or get in touch with us. It applies to everyone who uses our website, wherever you are. Section 13 sets out additional information and rights specific to the United Kingdom, the European Union/EEA, and South Africa.
1. Who we are
adamsnel.com is operated by Adams Nel, based in Scotland, United Kingdom. In this policy, “we”, “us” and “our” mean Adams Nel.
We decide how and why your personal information is processed — we are the controller (and, under South African law, the responsible party).
2. How to contact us
Email privacy@adamsnel.com, or use the contact form on our website. Region-specific contacts (our EU representative and our Information Officer) are in section 13.
3. What information we collect, use, and why
To provide goods, including delivery (our merchandise): names and contact details, delivery addresses, and order history. We do not collect or store your payment card or bank details — payment is handled by Fourthwall and its payment providers (see section 7).
To prevent, detect and investigate fraud and abuse: names and contact information, and technical information (such as your IP address and browser signals) processed by Google reCAPTCHA when you use a form on our site.
To comply with legal requirements: name, contact information, and any other information we are required to process (for example accounting and tax records).
To deal with your queries, complaints or claims: names and contact details, order history, and the contents of your correspondence.
Website analytics are privacy-first and cookieless; they do not track you across other websites, are not used for advertising or profiling, and are not sold or shared. See our cookies statement.
4. Our legal bases
- Contract — to provide goods and delivery.
- Legitimate interests — to prevent and investigate fraud and abuse (interest: protecting our customers, business and other users from loss, disruption and misuse) and to handle queries, complaints and claims (interest: responding to and resolving the matters you raise). We use only what is necessary and have weighed these interests against your rights.
- Legal obligation — to comply with the law.
(In South Africa these correspond to the “justifications” for lawful processing under section 11 of POPIA — necessity for a contract, compliance with a legal obligation, and legitimate interests — see section 13.)
5. Your rights
Wherever you are, you can ask us to:
- give you access to the personal information we hold about you;
- correct information that is inaccurate or incomplete;
- delete your information in certain circumstances;
- restrict or object to our processing of your information;
- port your information to you or another organisation; and
- withdraw consent where we rely on it.
To exercise any of these, contact us at privacy@adamsnel.com. We will respond without undue delay and within one month. There is no fee unless a request is clearly unfounded, repetitive or excessive. The exact scope of these rights, and how to complain to a regulator, depends on where you are — see section 13.
6. How long we keep information
We keep your personal information only for as long as necessary for the purposes above and to meet our legal, accounting and reporting obligations: enquiries and correspondence for 24 months after the matter is resolved; order and accounting records for 6 years; analytics held only in aggregate, cookieless form.
7. Who we share information with
Our processors (in South Africa, “operators”): Fourthwall, Inc. (an online merchandise and fulfilment platform in the United States), our merchandising partner and Merchant of Record, which hosts our checkout, processes payments, calculates and remits sales tax/VAT, and handles fulfilment, shipping and the returns process for merchandise orders on our behalf; Stripe and PayPal (payment within the Fourthwall checkout); and Google (reCAPTCHA security; Google Cloud hosting).
Others: professional and legal advisers; and any authority or organisation we are legally obliged to share information with.
We require everyone who processes information on our behalf to protect it and use it only on our instructions.
8. Sending information outside your country
Some of our processors, including Fourthwall and its sub-processors, are in the United States. Where personal information is transferred across borders, we rely on an appropriate safeguard recognised by the law that applies to you — see section 13 for the UK, EU/EEA and South Africa.
9. Cookies
Our website is built to be cookieless: we do not use cookies for analytics, advertising or tracking. The only cookies or similar storage involved are strictly necessary (Google reCAPTCHA and the Fourthwall-operated checkout). Our cookies statement explains this in full.
10. How we keep your information secure
We use appropriate technical and organisational measures to protect your personal information and have procedures to deal with any suspected breach. No method of transmission or storage is completely secure, but we take reasonable steps to protect it.
11. Children
Our website and merchandise are not directed at children, and we do not knowingly collect personal information from anyone under the applicable age (18 in the UK/SA context; 16 or the local age of digital consent in the EU/EEA). If you believe a child has given us personal information, contact us and we will delete it.
12. Changes to this policy
We may update this policy by publishing a new version on our website. Please check this page occasionally. Last updated 11 August 2026.
13. Regional information
United Kingdom. We process your information under the UK GDPR and the Data Protection Act 2018. UK→US transfers rely on the International Data Transfer Agreement (IDTA) (or the UK Extension to the EU-US Data Privacy Framework where the recipient is certified). You can complain to the Information Commissioner’s Office (ICO): Wycliffe House, Water Lane, Wilmslow, Cheshire, SK9 5AF; 0303 123 1113; ico.org.uk/make-a-complaint.
European Union / EEA. We process your information under the EU GDPR. If you are in the EU/EEA, you can reach our Article 27 EU representative via privacy@adamsnel.com. EU/EEA→US transfers rely on the EU Standard Contractual Clauses (2021/914) and/or the recipient’s certification under the EU-US Data Privacy Framework. You can complain to the data protection authority in your country of residence, work, or where the issue arose (see edpb.europa.eu).
South Africa. We process your information under POPIA as the responsible party; our processors above act as operators. You can reach our Information Officer via privacy@adamsnel.com. We process in line with POPIA’s eight conditions for lawful processing, and transfer information outside South Africa only on a basis permitted by section 72 (a recipient bound by substantially similar protections, necessity for your contract, or your consent). You can complain to the Information Regulator (South Africa): inforegulator.org.za; POPIAComplaints@inforegulator.org.za.
Other regions: visitors elsewhere (e.g. California/US, Canada, Australia, Brazil) buy merchandise through Fourthwall as Merchant of Record, which carries the bulk of local commerce and data obligations. We will add region-specific rights here if our direct obligations change.
